Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and I Hate Trivia regarding your use of iHateTrivia.com and its games and related services (the "Service"). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. Grim, but efficient.

1. Eligibility

You must be at least 13 years old to use the Service. If you are not old enough to enter a binding contract where you live, a parent or legal guardian must review and agree to these Terms for you. You may not use the Service if applicable law prohibits it.

2. Player Names

Player names are visible to other players. They must not impersonate others, expose another person's private information, infringe rights, or contain unlawful, threatening, or abusive material. You are responsible for the activity associated with the player name and browser you use. We may reject or change names that violate these Terms.

3. The Service

I Hate Trivia provides multiplayer and single-player trivia, including Classic, Battle, Category, Custom, and Daily modes. Features, question sets, room availability, limits, and supported devices may change. We may modify, suspend, or discontinue any part of the Service, including for maintenance, security, legal, or operational reasons.

4. Acceptable Use

You may not:

  • break the law or violate another person's rights;
  • harass players, submit hateful or exploitative material, or expose personal information;
  • cheat through automation, bots, answer scraping, collusion tools, or exploitation of bugs;
  • disrupt rooms, servers, security, or normal gameplay;
  • probe, reverse engineer, bypass, or defeat access, rate, moderation, or security controls except where law expressly permits;
  • scrape, copy, resell, or commercially exploit the Service or question database without written permission; or
  • use the Service to create or distribute unlawful, infringing, deceptive, or harmful content.

5. Your Content

You retain ownership of content you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, process, adapt, display, and transmit that content only as reasonably necessary to operate, secure, moderate, improve, and provide the Service. You represent that you have the rights needed to submit the content and grant this license.

6. AI-Generated Trivia

Custom trivia may use automated systems and third-party AI services. Generated questions and answers can be inaccurate, incomplete, biased, offensive, or unexpectedly weird. You must review outputs before relying on them. The Service is entertainment, not professional, medical, legal, financial, educational-testing, or safety advice. AI output does not determine legal or similarly significant rights.

7. Advertising

Free or selected parts of the Service may display third-party advertising. Advertising providers may process information as described in our Privacy Policy. An advertisement is not our endorsement of the advertiser, product, or claim.

8. Third-Party Services

The Service may depend on third parties, including Google, OpenAI, and infrastructure providers. Their terms may govern your use of their services. We are not responsible for third-party services, content, availability, or acts outside our control.

9. I Hate Trivia Property

The Service, including its software, branding, visual design, original text, graphics, question collections, and other materials, is owned by I Hate Trivia or its licensors and protected by intellectual-property laws. Except for the limited right to use the Service under these Terms, no rights are transferred to you.

10. Enforcement and Termination

We may investigate violations and restrict, suspend, or terminate access when we reasonably believe you violated these Terms, created risk or legal exposure, or threatened the Service or other users. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE OR TRIVIA CONTENT WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR CORRECT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THIS SECTION MAY NOT APPLY TO YOU.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, I HATE TRIVIA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED US$100. THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW.

13. Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless I Hate Trivia and its affiliates, officers, employees, contractors, and licensors from claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, misuse of the Service, or violation of these Terms or another person's rights. This obligation does not apply to the extent a claim results from our own unlawful conduct.

14. Disputes and Applicable Law

Before filing a formal claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days. These Terms are governed by applicable law, without overriding consumer protections that cannot lawfully be waived. Claims must be brought in a court with lawful jurisdiction over the dispute. Nothing in these Terms prevents either party from seeking urgent injunctive relief or using an eligible small-claims process.

15. Changes to These Terms

We may update these Terms. We will post the revised Terms and update the effective date, and will provide additional notice when required. If you continue using the Service after revised Terms take effect, you accept them. Material changes apply prospectively unless law permits otherwise.

16. General Terms

These Terms and the Privacy Policy are the entire agreement concerning the Service. If a provision is unenforceable, the remainder stays effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, or transfer of the Service. Headings are for convenience only.
